Preble v. Preble

Case 21-3-00460-32 | Spokane County Superior Court
June 24: Contempt found. Filing Motion for Revision to Superior Court Judge.
July 2: PO Termination 8:30 AM
July 8: All Motions 8:30 AM
Public hearings on Zoom — Commissioner Scharosch: 823 091 1413
July 2 — 8:30 AM

Terminate the Protection Order

The protection order that started everything. Filed through YWCA with no investigation, no police report, no event. It forced him from his home and killed his income. Now he's asking the court to terminate it. If the PO falls, the entire contempt chain collapses — because the PO caused the inability to pay.

July 8 — 8:30 AM

All Motions Heard

18 filings on the table. Modify child support to $0 (he has no income). Motion for the court to sign the quit claim deed she won't sign. Restrict abusive litigation. Appointment of counsel. Satisfaction of judgment showing $53K overpayment. The commissioner will have to address every one — on the record.

What Happened

2013 — Married. Built a painting business together over 8 years. Put her name on the house title.
2021 — Divorced. Clean decree. Agreed to child support. Started paying immediately.
2021-2025 — Paid $182,473 on a $129,300 judgment. Overpaid by $53,173. Exposed a pattern of institutional corruption and started building software to help other parents.
May 2025 — Asked ex-wife to sign the quit claim deed (remove her name from the house she doesn't live in). She refused.
Jun 2025 — Instead of signing, she filed an emergency protection order through YWCA. Claimed domestic violence. No investigation. No police report. No event. Just 5 pages of handwritten feelings from years ago.
Jun 2025 — Protection order forces him from his home and business. Can't work from the house he built. Income drops to $0.
Jan 2026 — Arrested at the courthouse doors the night before a hearing. Charged with "violating" the PO by parking on a public street. Car was unoccupied.
Apr 2026 — Ex-wife's attorney files contempt motion for non-payment. Mails papers to the house the PO forced him from. Papers come back undeliverable. They mail to the same address again.
Jun 24, 2026 — Commissioner finds him in contempt. Ignores the $53K overpayment. Ignores Turner v. Rogers (Supreme Court: can't jail someone who can't pay). Ignores that the PO caused the inability to pay. Awards attorney fees. Attorney fees become a lien on the house.
The pattern — Ask for the deed → get a protection order. PO kills income → can't pay. Can't pay → contempt. Contempt → attorney fees. Fees → lien on the house. The house was the target the entire time.

The case in five minutes

For counsel deciding whether to take it. The numbers, the thesis, the doors.

The thesis

A pro se father in Spokane County family court. After a clean divorce decree, a documented overpayment went unaddressed; due process was circumvented; he was isolated and displaced — including an arrest the night before a hearing on an eviction that was later dismissed when illegal entry was exposed.

This isn't a grievance. It's a documented pattern with a docket, exhibits, recordings, and dates — organized so you can verify each claim against the record, not take it on faith.

Full case brief → See the evidence →

The timeline

Every event, by phase, oldest to newest. Color = phase. Chips = exhibits & docket.

The evidence

What's documented and where it lives. Every number is a real count on disk.

Exhibits are hash-stamped and access-logged. Evidence is the owner's property — never sold, never crawled. Counsel access by request.

The violations

The patterns named in the record. Each ties to events in the timeline.

The Codex (all patterns) →

The story

The human version — the same events, told as the arc they form.
